Customers may not return an order for the purpose of repurchasing the same item using a subsequently applied discount code.

In the event that an attempt to return and repurchase with the intention of benefiting from an additional discount is detected, The New Beige reserves the right to cancel the second purchase, refuse the refund for the original order, or apply any measure deemed necessary to prevent the misuse of discount codes.

All intellectual works, trademarks, and other distinctive signs, graphics, texts, logos, icons, and, in general, all signs and/or utilities protected, or susceptible to being protected by the laws regulating Industrial and Intellectual Property made available to the public through this website, and whose ownership does not belong to the operators of The New Beige but to third parties, whether natural or legal persons, have been included with the prior express authorization of their legitimate owners.

The fact that The New Beige makes signs and/or utilities susceptible to protection by Industrial and Intellectual Property Law available to the public shall not, under any circumstances, be understood as granting any license for their exploitation, whether total or partial, without the express written authorization of their owners, whether they be the operators of The New Beige or third parties, natural or legal persons.

GENERAL TERMS OF SALE

1. Placing the Order

To place an order on The New Beige, the user must connect to the website http://www.thenewbeige.com/, and proceed to register or identify themselves as a user, in accordance with the provisions of section 1 of the General Conditions of Use ("Service Conditions"), completing the identification or registration form that appears in the store at each step and following the instructions indicated by the website itself. An order can also be placed as a guest on the page;

registration or login is not necessary for this. To do this, the user must follow the step-by-step instructions indicated on the website itself.

The validation of the order by the user implies that the user expressly states their knowledge of these General Terms of Sale and accepts them as the text formalizing the sales contract.

Unless proven otherwise, the data recorded by The New Beige constitutes proof of the set of transactions carried out between the operators of The New Beige and potential customers.

• Home delivery by courier: The home delivery courier service is available for shipments to be made worldwide.

The delivery of the goods will be made to the address designated by the sender, except in cases of repeated (up to two occasions) absence of the recipient.

In the event that the customer detects any problem at the time of delivery of their order (damaged packaging, deteriorated products, missing products, among others), they must report this fact to the operators of The New Beige by sending an email to the following address: Customer Service Department customers@thenewbeige.com, indicating the order number in the subject line.

Balearic Islands:

€8.00 (VAT Included). Free for orders over €100. Delivery: 24/72 hours.

Germany/Italy/France/Netherlands:

€18.00 (VAT Included). Free for orders over €175. Delivery: 4-8 business days.

UK:

€20 (VAT Included). Free for orders over €200. Delivery: 4-8 business days.

Exchanges are not accepted for orders outside the Peninsula or Balearic Islands.

Order Processing Times:

• Orders placed by the customer between 08:00 am and 12:00 pm Monday to Friday will be handed over to the transport agency the same day.
• Orders placed on weekends or holidays will be handed over to the transport agency the next business day.
• Orders placed Monday to Friday after 12:00 pm will be handed over to the transport agency the next business day.

Shipments may be delayed if there is low stock of the chosen product.

In case of delays in the delivery process, the customer will be notified by email.

It is understood that The New Beige is exempt from problems or delays with shipping in different situations:

• Problems with delivery locations and zones.
• Extraordinary situations and periods.
• Extraordinary weather conditions.
• Incorrect shipping and contact information.

Shipping costs will be shown separately before finalizing the purchase, when required.

This cost will be added to the final price of the items selected through The New Beige website.

5. Payment Methods

The payment methods currently offered by The New Beige are as follows:

• Payment by American Express or VISA or MASTERCARD or Apple Pay or Google Pay or Bank Transfer or Bizum or financing through Klarna: Payment by VISA or MASTERCARD card will be made according to the requirements and protocols established by the issuing entity of the corresponding credit card, with the charge being made according to the conditions established by said entity.
• In the event that the system reports the card denial, the order will be automatically cancelled, informing the customer of said cancellation online.
• Payment via PayPal: Directly to The New Beige account offered at the end of the payment process.
• Payment via Bank Transfer: Indicating the full name and order number. The transfer should be made to the IBAN indicated below: ES70 2100 7172 2502 0021 5025. The shipment will not proceed until the total amount of the transfer has been received.
• Payment via Klarna: Payment mechanism to split the total amount paid into installments. Conditions subject to the mentioned entity: https://www.klarna.com/es/paga-en-3-plazos/.

Not Different S.L. is not responsible for any eventuality that may occur during the credit card payment process, and which derives from the requirements established by the credit card issuing entity, or from non-compliance with the requirements established by international E-commerce Security regulations.

In this sense, payments by credit card that do not meet the requirements established in the previous paragraph will not be accepted, refunding the amount charged, if applicable, to the original card.

6. Right of Withdrawal, Exchange, and Returns

Exchanges or returns are accepted within 15 calendar days from the delivery of the order.

Unless we are in the Christmas period (from December 1 to January 1), in which case the period will be 30 calendar days.

For both exchanges and returns, items must be in perfect condition, unused.

The return of any item will be invalidated when one or more of the following circumstances occur:

• If the garment has been tampered with.
• If the garment does not have its original tags or they are not attached as sent.
• If the garment has been washed or shows clear signs of having been used.
• If the garment gives off any type of odour.
• If the customer's request is received after the 15 calendar days.
• Except for purchases made during the Christmas period (December 1 to January 1) which will have a period of 30 calendar days.

In any event, situation, or context, changes and returns will be processed online through the user's personal account, by accessing the orders tab and selecting the product(s) to be returned.

After managing the exchange or return, you will immediately receive the return/exchange label via email.

Once we receive the return, we will check that everything is correct and proceed to issue the refund via the original payment method.

The return, exchange, or withdrawal will be approved once the corresponding quality control check has passed.

Exchanges

• Cost: The costs for processing an exchange vary depending on the region and country. FREE FOR SPAIN (PENINSULA) AND PORTUGAL.
• Gift Card: Exchanges are not permitted for purchases paid with a gift card.

Returns

8. Product Warranty

The warranty period for products offered by The New Beige is two years following the delivery of the product.

The user must inform of the lack of conformity within two months of becoming aware of it.

Notwithstanding the foregoing, users are informed that said warranty period does not include, in any case, product deficiencies caused as a result of negligence, incorrect use, improper handling, materials worn out as a consequence of misuse, and, in general, any other type of non-diligent action by the customer in relation to the product.

In those cases where the use of the product warranty by the customer is justified, The New Beige will proceed with the replacement of the item, price reduction, or refund, by virtue of the provisions established by current regulations on the matter, these procedures being free of charge for the user.

To make use of the warranty, presentation of the proof of purchase is essential.

The customer must send an email to the address customers@thenewbeige.com and await the instructions that will be sent to their email address.

9. THE NEW LOVE Initiative

The New Love initiative developed by The New Beige aims to create sustainable fashion thanks to its idea of fashion recirculation.

With this initiative, garments and/or products identified with The New Love label can be returned by users.

Thus, from The New Beige, we will create sustainable collections and collaborate through their sale in the development and growth of sustainable programs promoted by both non-profit organizations and/or public administrations.

All these collaborations will be duly indicated and certified.

The summarized way to describe the functioning of this initiative is:

• The user buys a product identified with The New Love label.
• After two years, they return it.
• The New Beige receives the product and gives the user a 20% discount for their next purchase.
• The New Beige creates a collection with all the collected products and, through its sale, will collaborate in the development of sustainable initiatives.

How to participate in THE NEW LOVE initiative?:

• Be registered as a user of The New Beige.
• Have made purchases as a website user and not as a guest.
• Have purchased garments and/or products with The New Love label.
• Two years must have passed since the purchase of the product to be returned.
• The user does not need to keep the receipt; simply access their user account and under purchases, they can see which item is part of the initiative and if the return can already be made.
• Likewise, when the date is met, a reminder email will be sent.
• To make the return, the user will have to send the product(s) to the address we will indicate during the return process.
• The user will pay the return shipping costs but can do so through agencies collaborating with The New Beige, so the cost is lower.
• In return, once we receive the product(s), The New Beige will email the user a 20% discount code for their next purchase (personal and single-use code).
• Think not only of the discount you get but also the satisfaction of collaborating to make a cleaner, more ethical, and sustainable world.
• Because with that product(s) you return, we will create a collection that will help non-profit organizations make this planet a better place.
• *The condition of the garment does not matter. Don't throw it away; with The New Love, all identified The New Beige garments or products can make many more people, animals, or plants happy.

IMPORTANT Issues of The New Love program:

• The user will receive one 20% discount code for each garment sent that is part of The New Love program.
• Discount codes are not cumulative, and only one code can be used per purchase made by the user.
• Obtained discount codes will not be cumulative with other offers and/or discounts.
• The user must return a garment that can be clearly identified as being from The New Beige.
• The condition of the garment does not matter, but it must be demonstrable that it is from The New Beige. To do this, the neck label must be preserved.

10. THE LOYALTY PROGRAM

Through THE LOYALTY PROGRAM, the user levels up and thus acquires more benefits/advantages based on their point accumulation. These points are earned through purchases at The New Beige.

• THE LOYALTY PROGRAM has no cost for the user.
• The levels are: Beginner > Expert > Veteran > Master.
• Beginner (from program registration):
  • Exclusive offer for the user's birthday.
• Expert (150 points):
  • Beginner benefits
  • Presale access one week in advance for all launches.
• Veteran (275 points):
  • Beginner + Expert benefits
  • Free shipping on all orders from the moment Veteran level is reached.
• Master (500 points):
  • Beginner + Expert + Veteran benefits
  • THE LOYALTY Gift.
• €1 = 1 point, valid for 12 months.
• For access to early sales, the user, by being part of THE LOYALTY PROGRAM, agrees to receive notification via email with access keys and the link for each early sale.
• THE LOYALTY gift varies each year. Once the MASTER level is reached, the user must access the user panel to initiate the order for their gift or follow the instructions sent via email.

Information Accuracy: By using Facebook Login, you authorize Facebook to share certain profile information with us, as described in our Privacy Policy. You represent that the information associated with your Facebook account that is shared with us is accurate and current. The New Beige (Not Different S.L.) is not responsible for inaccuracies in information received from Facebook based on your profile settings or the permissions you grant.

Facebook's Terms: Your use of the Facebook Login feature is also subject to Facebook's own Terms of Service and other applicable policies. By using Facebook Login on our Site, you acknowledge and agree to comply with Facebook's terms.

Service Availability: The availability of the Facebook Login feature is dependent on Facebook's platform and APIs. The New Beige provides this option as-is and is not responsible if the Facebook Login service becomes unavailable or experiences technical issues originating from Facebook's side.

Account Linking: Using Facebook Login will typically link your Facebook User ID to your The New Beige user account in our system for authentication purposes.
